Who we are

These terms are an agreement between you and Ecomz Inc., a company registered in Quebec, Canada, in the Registre des entreprises du Québec. CommerceGenie is a brand of Ecomz Inc. "We" means CommerceGenie.

What these terms cover

This website, the waitlist, the work our team does for you, and our Agent Apps once they launch. Our Privacy policy explains how we handle your data.

Prices and credits can change

Please read this part. Our services and apps run on AI, and what AI costs keeps moving. Cheaper models can bring our costs down. Smarter models, and more technology for a better service, can push them up.

  • We may change our prices, our plans, and how many credits each action costs. A price in a proposal or quote you've signed holds for that job; changes apply to new quotes, plans and credits.
  • A change to what an action costs applies to all credits, including credits you've already bought. What you paid for a credit pack is never taken back.
  • We tell you before a change takes effect: at least 15 days ahead when it's urgent or we need it to stay competitive, and up to 30 days ahead otherwise.
  • We keep changes reasonable, and we work to stay competitive on both price and quality.
  • If you don't accept a change, you can cancel before it takes effect. If you keep using our services or apps after that date, you accept it.

We tell you by email, at the address on your account or the one you gave us, and the Pricing page shows the new prices.

Our services

Work our team does for you, like building, moving or running your store, is described in the proposal you accept for it. These terms apply to that work too. If the proposal and these terms disagree, the proposal wins.

Payments for our services are not refundable.

The waitlist

When you join the waitlist, you say yes to marketing emails from CommerceGenie, starting with news of the Agent Apps you picked. You can unsubscribe at any time. Joining doesn't oblige you to buy anything.

Using the Agent Apps

You need a Shopify store. You install each Agent App from the Shopify App Store, and Shopify's own terms apply too.

You're responsible for your store and for what you ask the apps to do.

Plans, credits and billing

  • Shopify bills your Agent App plans, monthly or yearly, on your Shopify bill.
  • Credits work as our Pricing page explains: a run that fails gives its credits back, unused plan credits carry over for up to 3 months, and credit packs you buy never expire.
  • You can change or cancel a plan anytime in your Shopify admin.
  • Genie Wishes add extra credits for certain actions. We may change the Wishes on offer; credits you've already earned stay yours.

What the apps make

Our AI agents write drafts and suggest changes to your store. Nothing goes live until you approve it.

AI can make mistakes, so check facts, prices and claims before you publish. You're responsible for what you publish.

Your store's content stays yours, including what the apps write for you. You allow us to use your store's data only to do the work for your store; we never use it to improve our apps.

Fair use

Don't use this website or the Agent Apps to break the law, mislead shoppers, copy other people's work, or harm our systems or other stores. Don't copy, resell or take apart our apps.

Our brand and software

CommerceGenie, the Agent Apps and this website belong to Ecomz Inc. Shopify and the Shopify logo are trademarks of Shopify Inc.

Changes

AI moves fast, so we update our services, our apps and these terms regularly.

  • For an important change to these terms, we tell you at least 15 days before it takes effect.
  • Small fixes, and changes the law or our AI providers require, take effect right away.
  • We tell you by email, at the address on your account or the one you gave us, and this page shows the new date.
  • If you keep using our services or apps after a change takes effect, you accept it. If you don't, you can stop before that date.

A change to prices or credits follows Prices and credits can change.

If things go wrong

We work to keep our services and apps running and accurate, but we can't promise they'll never stop or never make a mistake. We make no promises about them beyond what these terms and your proposal say.

If we're responsible for a loss, the most we owe you is what you paid us in the 3 months before your claim, for the service or Agent App that caused it.

We're not responsible for causes outside our control, such as Shopify, other apps, outages, or content you approved and published. We're not responsible for indirect losses, such as lost sales or lost profit.

These limits don't apply where Quebec law doesn't allow them, for example to a loss caused on purpose or by gross fault.

Ending

Work on a proposal ends as the proposal says. You can stop using an Agent App anytime by removing it from your Shopify admin. We may suspend an account that breaks these terms.

The law that applies

The laws of Quebec and of Canada apply to these terms, and the courts of Quebec settle any dispute.

If you're a consumer, you keep the rights the consumer protection law where you live gives you, and nothing in these terms takes them away.
